State v. Stavola

Maricopa County Superior Court Judge Kreamer accepted the City of Phoenix's special action in the case of Stavola.

Finding: Neither of the two medical marijuana provisions:

 

36-2802(D). Arizona Medical Marijuana Act; limitations This chapter does not authorize any person to engage in, and does not prevent the imposition of any civil, criminal or other penalties for engaging in, the following conduct; nor,

36-2811(A)  A. There is a presumption that a qualifying patient or designated caregiver is engaged in the medical use of marijuana pursuant to this chapter;

 

create a defense to either A.R.S. §§ 28-1381(A)(1) or (A)(3).
